Terms and Conditions

 

BMS Warehouse Gym Ltd, referred to as 'BMS Warehouse Gym' or the 'Gym,' requires all customers to accept the following Waiver & Release of Liability before using our facilities or services. By agreeing to the following, you acknowledge the inherent risks involved in physical exercise and agree as follows:

  1. Waiver & Release: In consideration for the services rendered by BMS Warehouse Gym for my personal physical-fitness use, I hereby waive any rights, claims, or damages for injuries that may occur as a result of my participation in any fitness/nutrition program, gym use, gym classes, or online classes. I agree to disclose any physical limitations, disabilities, ailments, or impairments that may affect my ability to participate in such activities. If my condition may be aggravated by exercise, I will not participate without medical clearance from my General Practitioner. I understand that BMS Warehouse Gym is a fitness company and not a medical doctor, and that they will rely on my representations and disclosures regarding my health and physical condition. I also acknowledge that BMS Warehouse Gym shall not be held liable for any personal injuries, bodily injuries, or property damage occurring during my commute to and from the Gym.

Membership Terms & Conditions:

  1. Membership Rules: All membership rules outlined herein apply equally to gym members, class pack members, temporary members, pay-as-you-go (PAYG) members, and free class members. Members must comply with the following rules to ensure the proper and safe use of facilities and allow all members to fully enjoy their experience without interfering with others.
  2. Cancellation and Refunds: Memberships at BMS Warehouse Gym are subscriptions. If cancelled, your membership status is automatically removed.
  3. Membership subscriptions should only be cancelled on the last day of your membership term. No refunds will be provided for auto-renewed memberships after the transaction has been processed. Clients with BMS class packs must book the relevant class and time slot to guarantee access.
  4. Third-party personal trainers are not allowed to conduct business at BMS Warehouse Gym. Failure to adhere to this policy may result in session and/or membership cancellation.
  5. Cancellation policy: Members should cancel if unable to attend to free up space for wait-listed individuals. Cancellations can be made in the "My Account" section of the BMS Warehouse Gym website. Refund requests should be emailed to info@bmswarehousegym.ie.
  6. Refunds will not be provided for cancellations within 12 hours of the event start time or after the event has passed or the renewal date has passed.
  7. Double bookings will receive a credit, and no refund will be given due to stripe fees incurred.
  8. All membership types are non-transferable and non-refundable.
  9. Memberships may not be shared.
  10. All members must be over 16 years old to use the facilities and services provided at BMS Warehouse Gym.
  11. Parents must sign a consent form for children under 18 years old to join.
  12. Members aged 8 - 15 years may not use the main gym or attend group classes on the regular timetable. There is a separate training space provided for supervised youth group training. All participants must have a signed waiver and consent form from their guardian. By signing, guardians agree to indemnify and hold harmless BMS Warehouse Gym, its staff, owners, or third-party workers from any liability arising from injury or fatality to their child.
  13. Under 16 years old members are not permitted to lift free weights. This is a strict insurance requirement.
  14. Membership may be renewed upon payment of the prevailing fee and in accordance with the terms and conditions then in force.
  15. BMS Warehouse Gym reserves the right to increase membership and subscription prices for new and existing memberships at any time and will give 4 weeks notice , by email, gym signage and social media.
  16. By joining the gym, members automatically accept and agree to be bound by these conditions of membership. The Gym may temporarily close all or part of its facilities for maintenance work or any other necessary purposes, for a maximum period of seven working days.
  17. All gym members must scan their barcode for access to the facilities on each visit to the Gym.
  18. All gym members must book an appointment through the BMS Warehouse Gym website booking facility.
  19. Entry will only be permitted to those with a valid membership, within the expiration date and with an agreed acceptance of the terms and conditions of entry.
  20. As a member, you agree to comply with the Gym's rules regarding facility use, opening hours, and conduct.
  21. Reasonable changes to these rules may be made by the Gym, with advance notice provided.
  22. You may obtain personal insurance at your discretion and expense to cover any loss, injury, or damage that you might sustain while using the Gym.
  23. You exercise at your own discretion and accept any resulting injury or illness as your own responsibility. Members wishing to report accidents, incidents, or problems with Gym services should contact the staff member on duty or email info@bmswarehousegym.ie within 2 hours. In the event of a breach of membership rules and regulations, the Gym reserves the right to refuse admission and may require any member or PAYG user to leave the premises. Any member/PAYG/free user found in breach of rules or engaging in illegal activities, including theft, will be permanently expelled from the Gym without a refund. Shelves are provided for members and PAYG users, and items left on shelves are strictly at the member's own risk.
  24. The Gym reserves the right to adjust its opening hours as necessary for the proper operation of the centre and to comply with public health requirements.
  25. Throughout your membership with the Gym, regular health and medical screenings should be sought from your General Practitioner. Before using the fitness facilities, it is mandatory to complete a basic introductory session with a staff member to ensure proper equipment understanding and adoption of a safe training regime.
  26. Please consult a staff member before commencing any exercise.
  27. All facility users must wear appropriate, clean attire and footwear when using the studio and gym.
  28. If you feel dizzy, faint, unwell, or experience unusual pain, you must immediately cease exercising and inform a staff member. Members must have a hand towel while training in the Gym for hygiene purposes and must wipe down each piece of equipment after use.
  29. Group Training Members and PAYG users must inform the instructor of any injuries, pains, or concerns prior to the session.
  30. Training while injured is not permitted.
  31. CardioRevive members who are coming for phase 4 cardiac rehab must have a completed transfer form sent to BMS Warehouse Gym prior to commencing exercise.

Payment Terms & Conditions:

Payment and Cancellation:

  1. BMS Warehouse Gym reserves the right to increase membership subscription prices for new and existing memberships at any time and will give 4 weeks notice , by bookings system email, gym signage and social media.
  2. Memberships, courses, and group training sessions must be paid in full prior to utilizing the service. Services not cancelled within the 12-hour commencement time limit will be charged accordingly.
  3. Memberships are subscription-based, and no refunds are provided once payments are made.
  4. Members can cancel their membership at any time through their account page on the BMS Warehouse Gym website.
  5. Cancellation immediately voids future bookings.
  6. Membership freezes are not allowed. 
  7. Refunds due to members contracting COVID-19 will not be given.
  8. All membership rules contained herein apply equally to gym members, group training members, PAYG users, and Personal Training clients.

General Facility Rules:

  1. Please always be courteous to staff and other members while using our facilities.
  2. Dress appropriately. Make sure clothing and footwear are clean and suitable for exercise.
  3. Bags are not permitted on the floor. Please use the shelves provided.
  4. Please do not drop or throw weights. Please ask a staff member or fellow gym client if you need a "spotter." Safety is a priority. Always allow other members to "work in" between your sets on machines or benches.
  5. Please always return weights, plates, bars, and dumbbells to their designated places after use.
  6. Please use the cleaning stations provided and wipe down machines and benches after use.
  7. Only lift weights that you can handle safely.
  8. Excessive noise will not be tolerated.
  9. Please be considerate of neighbouring businesses. Individuals not adhering to these rules may be asked to leave.

Group Training Rules:

  1. Booking and Attendance: All group training sessions are subject to alteration and operate on a first-come, first-served basis.
  2. Bookings can be made through the BMS Warehouse Gym website or at the Gym's reception. Telephone, email, or social media bookings are not accepted. Members must pre-book to attend a group training session.
  3. Timetables and instructors are subject to change without notice.
  4. Bookings can be made in advance according to the current timetable.
  5. Please check availability on the BMS Warehouse Gym website. Group training sessions fill up quickly, so advanced booking is recommended.
  6. Members must cancel their booking if unable to attend, with penalties imposed for non-compliance.
  7. Refunds will not be provided for cancellations within 12 hours of the event start time or after the event has passed or the renewal date has passed.
  8. Double bookings will receive a credit, and no refund will be given due to stripe fees incurred.

By using our facility and services, you agree to the terms and conditions stated above. Please read and understand the agreement before signing below. This agreement is effective immediately.
